Islamic Sharia Law Proliferates in Germany

The spread of Islamic Sharia law in Germany is far more advanced than previously thought, and German authorities are "powerless" to do anything about it, according to a new book about the Muslim shadow justice system in Germany.

The 236-page book titled "Judges Without Law: Islamic Parallel Justice Endangers Our Constitutional State," which was authored by Joachim Wagner, a German legal expert and former investigative journalist for ARD German public television, says Islamic Sharia courts are now operating in all of Germany's big cities.

This "parallel justice system" is undermining the rule of law in Germany, Wagner says, because Muslim arbiters-cum-imams are settling criminal cases out of court without the involvement of German prosecutors or lawyers before law enforcement can bring the cases to a German court.

Settlements reached by the Muslim mediators often mean perpetrators are able to avoid long prison sentences, while victims receive large sums in compensation or have their debts cancelled, in line with Sharia law, according to Wagner. In return, they are required to make sure their testimony in court does not lead to a conviction.

German police do investigate cases involving serious crimes. But parallel to that, special Muslim arbitrators, also known as "peace judges," are commissioned by the families concerned to mediate and reach an out-of-court settlement.

In an interview with the German broadcaster Deutsche Welle, Wagner said political correctness in Germany is contributing to the problem: "I've studied 16 recent crime cases here with Muslim citizens involved. In almost 90% of all cases where Muslim arbitrators were commissioned, the perpetrators were acquitted by German courts or the cases were dropped altogether by the prosecution for lack of evidence. It's an alarming finding, and it throws a bad light on our courts."

In fact, German judges often refer and/or defer to Sharia law. For example, the Federal Social Court in Kassel recently supported the claim of a second wife for a share of her dead husband's pension payments, which his first wife wanted to keep all to herself. The judge ruled they should share the pension.

In another case, the Administrative Appeals Court in Koblenz granted the second wife of an Iraqi living in Germany, the right to stay in the country. She had already been married to him and living in Germany for five years, after which the court said it would not be fair to send her to Iraq alone.

A judge in Cologne ruled that an Iranian man should repay his wife's dowry of 600 gold coins to her after their divorce – referring to the Sharia which is followed in Iran. A court in Düsseldorf arrived at a similar verdict, forcing a Turkish man to repay a €30,000 ($43,000) dowry to his former daughter-in-law.

In March 2007, Judge Christa Datz-Winter, a judge at Frankfurt's family court cited the Islamic Koran in a divorce case involving a 26-year-old German woman of Moroccan origin, who was terrified of her violent Moroccan husband, a man who had continued to threaten her despite having been ordered to stay away by the authorities. He had beaten his wife and he had allegedly threatened to kill her.

Judge Datz-Winter refused to grant the divorce, arguing that a woman who marries a Muslim should know what she is getting herself into. In her ruling, the judge quoted Sura 4, verse 34 of the Koran. She wrote that the Koran contains "both the husband's right to use corporal punishment against a disobedient wife and the establishment of the husband's superiority over the wife." [Editor’s Note: This is essentially the same reasoning used by a New Jersey judge in 2009 when he denied a restraining order sought by a Muslim woman against her husband who was sexually assaulting her several times a day.]

In February 2011, Germany's Federal Labor Court ruled that a Muslim supermarket employee can refuse to handle alcohol on religious grounds. The case in question involved a Muslim man who was employed in a supermarket in the northern German city of Kiel. He refused to stock shelves with alcoholic drinks, saying that his religion forbade him from any contact with alcohol, and was dismissed as a result in March 2008.

In an interview with the German newsmagazine Der Spiegel, Wagner described the Islamic shadow justice system in Germany as "very foreign, and for a German lawyer, completely incomprehensible at first. It follows its own rules. The Islamic arbitrators aren't interested in evidence when they deliver a judgment, and unlike in German criminal law, the question of who is at fault doesn't play much of a role."

When Der Spiegel asked why it was wrong for two parties to try to resolve a dispute between themselves, Wagner replied: "The problem starts when the arbitrators force the justice system out of the picture, especially in the case of criminal offenses. At that point they undermine the state monopoly on violence. Islamic conflict resolution in particular, as I've experienced it, is often achieved through violence and threats. It's often a dictate of power on the part of the stronger family."

Wagner's findings largely confirm a report published by the German Interior Ministry in 2009 which warned that Islamic groups in Germany want to live under Sharia law in Germany.

They know how important these victories are. Muslim Brotherhood front organizations and their enablers have become so frightened by our victories they are pulling out the stops in a desperate, fever pitch effort to try to keep us from winning any more victories.

For instance, they have put out at least five so-called “reports” in just the past five months that claim to document a rising “Islamophobia” in America. What these reports amount to is a slick disinformation, name-calling propaganda campaign designed to intimidate organizations like ACT! for America. A state representative in Michigan, a Muslim, went so far as to preposterously and falsely claim that support for “American Laws for America Courts” is “racism at its core.”

Our opponents know what’s at stake—and the stakes right now are HIGH.

They know if we succeed in erecting legislative firewalls against sharia across the country, the efforts of the Muslim Brotherhood—to impose sharia law on America—will be severely damaged!

Will we be able to continue to stoke the fires of our momentum? Or will the coordinated propaganda campaign of our opponents seize the momentum from us?

Washington, DC (August 31, 2011) – A coalition of diverse American Muslim leaders has announced support for a proposed bill in the Michigan State Assembly, HB 4679, that is intended to bar Michigan courts from enforcing any foreign law, if doing so violates any rights guaranteed by the U.S. Constitution and/or the state of Michigan’s constitution.

Like many Americans, members of the American Islamic Leadership Coalition (AILC) have been observing the efforts of a growing number of state legislatures, which are seeking to address the incompatibility of various shari‘ah court systems around the world with the principles and foundations of our Constitutional republic and its laws. As American Muslims, we believe that the law should treat people of all faiths equally, while protecting Muslims and non-Muslims alike from extremist attempts to use the legal instrument of shari‘ah (also known as Islamic jurisprudence, or fiqh) to incubate, within the West, a highly politicized and dangerous understanding of Islam that is generally known as “Islamism,” or “radical Islam.”

We see no evidence that statutes like HB 4769 will adversely impact the free exercise of our personal pietistic observance of Islam, which is not in conflict with the U.S. or Michigan constitutions. We recognize that not only Muslims, but also Jews, Christians and all people of faith need the government to protect their right to peaceful assembly, mediation and arbitration free of coercion, but also within the bounds of American constitutional principles. Therefore, we stand together as a diverse coalition in support of any legislation that serves to protect and integrate our communities into the fabric of this great nation, by strengthening our accountability to the laws of the land, and the constitutions of the various states in which we live.

As American Muslims we are conscious of the fact that Muslim Brotherhood legacy groups and other Islamists and their surrogates in the U.S. are trying their best to portray any opposition to manifestations of shari‘ah law as “racism” and “discrimination against Muslims.” However, as a coalition of traditional, liberal and secular Muslim Americans, we denounce this fear-mongering and playing of the race card, which only serves to mask the Islamists’ highly politicized agenda. According to AILC member C. Holland Taylor, “the Islamist agenda threatens not only the well-being of the United States and its inhabitants, but also undermines and distorts the highest principles of Islam itself.”

“Michigan House Bill 4769 seeks to ensure that American Muslims can live in freedom and safety, in accordance with our constitutional principles, and not be enveloped by the tentacles of medieval, man-made laws that have been falsely accorded divine status,” said the AILC.

“To equate Bill 4769 to racism is not only dishonest, but is a poor and clumsy attempt at making ordinary Muslim Americans feel alien in their own homeland, while creating a rift between Muslims and the rest of our country,” said AILC member Dr. M. Zuhdi Jasser.

Michigan House Bill 4769 states:

“[To] ...limit the application and enforcement by a court, arbitrator, or administrative body of foreign laws that would impair constitutional rights; to provide for modification or voiding of certain contractual provisions or agreements that would result in a violation of constitutional rights; and to require a court, arbitrator, or administrative body to take certain actions to prevent violation of constitutional rights.”

The AILC statement reinforces the American Muslim community's commitment to the First Amendment’s Establishment Clause and the separation between religion and state. Unfortunately, Islamist groups would like to compromise this separation and provide cover to medieval, misogynistic and homophobic laws that no Muslim is obligated to demand as public law.

“Shari‘ah law, wherever it has been applied in the public domain, be it in Iran, Saudi Arabia or Pakistan, has resulted in untold misery and oppression of Muslims, in particular Muslim women, by Islamists and dictators who invoke shari‘ah law to justify their rule,” said AILC member Manda Ervin. “Many of us fled the Muslim world to escape shari‘ah law and to practice Islam in our personal lives, by moving to the USA and other western countries. We do not wish these laws to follow us here,” she concluded.

The Michigan state senators are not alone in expressing concern about foreign laws creeping into North America under the guise of religious freedom. Many Muslim academics, religious scholars and human rights activists have voiced their concern.

The contrast between what has occurred in Britain and in Canada provides a roadmap for how the U.S. may address these legal issues. In Britain, shari‘ah arbitration courts have been allowed to assume virtually unchecked control of legal arrangements in many Muslim communities. This is creating a ghettoized, medieval and separatist state within Britain. In Canada, however, local Muslims led strong opposition to the Islamists’ shari‘ah agenda and were successful in preventing its implementation, thereby sparing our Northern neighbor the fate of so many Muslims in the United Kingdom, where women are commonly subjected to forced marriage and the denial of basic human rights.

“We Muslims in Canada defeated an attempt by Islamists to sneak shari‘ah law into Ontario,” said AILC member Tarek Fatah, who has been on the front lines of this struggle for many years. “We recognized the damage shari‘ah had inflicted on Muslims in the UK, and its oppressive nature in Muslim-majority countries, and decided to oppose it. We urge American Muslims not to succumb to the Islamists’ propaganda, and to back the Michigan Bill, which will protect Muslims and non-Muslims alike from the impact of foreign laws that violate the U.S. or Michigan constitutions.”

Hundreds attend rally in Tulsa


Dear Elaine,

Yesterday, hundreds of people attended our rally in Tulsa on behalf of Captain Paul Fields. The news story below, with a picture of Guy Rodgers speaking at the rally, was one of over a half dozen news stories covering the event.

After the rally, Rodgers delivered the ACT! for America petition, signed by over 53,000 people, to Mayor Dewey Bartlett.

Yes, there were counter-demonstrators, organized by a group calling itself the “Say No To Hate” Coalition. Visit here to see the Fox 23 News story and video of the rally and the counter-demonstration.

Rodgers’ message at the rally was straightforward: Captain Fields was given an unlawful order to attend a “Law Enforcement Appreciation Day” that included observing the local mosque’s Friday prayers and attending a class in Islamic doctrines—an order that violated his constitutional rights.

Rodgers asked:

Do you believe, in today’s politically correct culture, that a police chief, in Tulsa or anywhere else for that matter, would force a Muslim officer to attend Christian services and classes as part of a “Law Enforcement Appreciation Day”?

Rodgers went on to state that he would agree with a Muslim police officer who refused an order to attend such an event, as this would be a violation of the Muslim’s rights—in the same way that Fields’ rights were violated.

As for the counter-demonstrators, they did not address the message of the rally, that the rights of Captain Fields were violated.

This is typical. Our opponents rarely, if ever, speak to the substance of our concerns. Instead, they name call and engage in character assassination—in the name of tolerance, of course.

Apparently, in their politically correct worldview, standing up for the constitutional rights of a police officer constitutes “hate.”

Hundreds rally downtown for a Tulsa Police Captain who they feel was wronged because of political correctness.

Paul Fields disobeyed an order to send officers to a law enforcement appreciation event at the Al Salam Mosque in Tulsa. For that infraction, Fields was suspended for two weeks.

Tuesday’s rally was organized by the group Act for America. Guy Rodgers is the organization’s Executive Director.

He has a message for Tulsa Mayor Dewey Bartlett and Police Chief Chuck Jordan: “Before you lose in court do the right thing now and show the people of Tulsa that you’re listening to them.”

Rodgers argued “This is all about respect for the constitution, respect for the rule of law, and it’s about respect for the rights of a law enforcement officer who was given an unlawful order.”

Those attending a counter-rally would probably beg to differ. Said one woman wearing a Say No to Hate t-shirt: “I think it’s amazing that so many Oklahomans that purport that they are Christians, have such hate in their hearts."

Mana Tahaie is Director of Racial Justice at the YWCA and a member of Tulsa’s Say No to Hate Coalition: “We know that Act for America is very strategic about using opportunities in communities to gin up Islamophobia.”

Last winter Fields was told by his superiors to send some of his officers to an open house at the mosque. He responded by saying he felt the order was unlawful and was against his personal religious beliefs.

Tlaib, legislation known as “American Laws for American Courts” is “racism at its core.” According to Tlaib, this legislation, which we have succeeded in passing, with strong bi-partisan support, in Tennessee and Arizona, is “racism at its core.” According to Tlaib, the legislation, which prevents state courts from countenancing foreign laws in areas such as family law, which would protect Muslim women from the discriminatory nature of sharia law, is “racism at its core.”

Americans are waking up to the threat of sharia—and that’s why we’re seeing a desperate push-back by people like Rep. Tlaib. A push-back that is disingenuous and thoroughly devoid of fact and logic.

For instance, how can opposition to a theo-political law system such as sharia be “racist”? Sharia isn’t a “race.” Islam isn’t a “race.”

CAIR-Chicago attacks high school curriculum, wants to rewrite history

The CAIR-Chicago post below (highlights added) falls into the category of “you’ve got to be kidding me!”

CAIR-Chicago is objecting to a curriculum used in the Chicago school district. CAIR-Chicago’s complaint?

The worksheets in question, produced by MindSparks, a California based educational resource company, teaches students that the religion of Islam is oppressive towards women, inherently violent, and played an important role in harboring slavery.

CAIR-Chicago claims verses from the Qur’an used in this curriculum are “taken out of context.” This is a typical response from Muslim Brotherhood front organizations like CAIR (Council on American-Islamic Relations). The problem is, anyone who has ever read the Qur’an knows two things:

	1)	There is very little “context” to its writings.
	2)	It does contain numerous passages that make clear women hold second-class status to men, that call for violent jihad against “infidels,” and that sanction the taking of slaves in the prosecution of jihad.

Finally, we see what appears to be a factual rendering of the history of Islam. For instance, the curriculum states, accurately, that “slavery was common in Islam.” Various historians and scholars estimate that between 14 and 18 million Africans were enslaved by Muslims from the 7^th century to the 12^th century.

CAIR-Chicago clearly wants to rewrite history because it obviously doesn’t want Chicago high school students to be exposed to these “inconvenient truths.”

While the high school is not mentioned in the post below, you can contact the Chicago public schools office via email and thank the school for using this curriculum. Encourage them to retain the curriculum and resist the interference of CAIR-Chicago, which is part of the national CAIR organization. Make sure you mention that CAIR was an unindicted co-conspirator in the largest terrorism financing trial in America’s history and that it has been identified by the Justice Department as linked to the terrorist organization Hamas.

No school district should be paying any attention to CAIR or any of its local affiliates.

Staff Attorney Rabya Khan Meets with High School Regarding Anti-Muslim Worksheets

CAIR-Chicago Staff Attorney Rabya Khan met with officials at a Chicago-area high school on Monday, August 15th, regarding a complaint CAIR-Chicago received by a parent alleging that the high school’s social studies class is distributing misleading worksheets on Islam. The worksheets in question, produced by MindSparks, a California based educational resource company, teaches students that the religion of Islam is oppressive towards women, inherently violent, and played an important role in harboring slavery.

One of the readings contains verses from the Quran which are quoted out-of-context wrongly giving the impression that women are considered inferior to men. A corresponding worksheet then asks: “The Qur’an stresses the equality of all believers. Yet many say its views about men and women definitely give men more power. How does the top passage here from the Qu’ran support this view?” The reading is accompanied by a photo of two women in burqa, a full-body covering worn by only a minority of Muslim women worldwide. The inauthentic translation, imagery, and presentation of information leads students to a biased conclusion about the status of men and women in Islam.

Another reading implies that slavery was an encouraged practice in Islam, and then the corresponding worksheet states “Slavery was common in Islam; however, it took several very different forms. […] Prepare a brief talk to the class on what you learn about these two forms of slavery. Title your talk, “Slavery’s Many Forms in the Islamic World.”” Wrongly suggesting some sort of link between slavery and Islam. In reality, the Qu’ran strongly condemned slavery and offered enticing rewards to those who freed slaves. Prophet Muhammad himself freed numerous slaves and the situation for slaves greatly improved with the advent of Islam.

In the MindSparks’ textbook The Rise of the Modern Middle East, lesson titles include “Islam and Islamic Radicalism”. The parent who brought these reading materials to CAIR-Chicago’s attention expressed concern that that over emphasis on the small number of radical Muslims in the world will reinforce stereotypes that link Islam and terrorism and that students will not receive a balanced understanding of Islam and Muslims.

Rabya Khan met with school officials to convey the importance of presenting balanced perspectives and not perpetuating stereotypes. CAIR-Chicago has requested that the school remove the worksheets, and not use them again or any similar worksheets. Rabya also provided a resource list of organizations that can conduct workshops on Islam, including CAIR-Chicago, and is compiling a list of educational resource companies with balanced materials on Islam and Muslims.

Islam displays its honour-shame sensibilities

Politeness is not saying certain things lest there be violence; civility is being able to say those certain things and there won’t be violence.

A recent series of polls indicate that European public opinion is substantially concerned by the increasingly aggressive Islam that their substantial immigrant populations have taken to expressing. To quote Soeren Kern, Senior Fellow for Transatlantic Relations at the Madrid-based Strategic Studies Group:

The findings – which come as Europeans are waking up to the consequences of decades of mass immigration from Muslim countries – point to a growing disconnect between European voters and their political masters regarding multicultural policies that encourage Muslim immigrants to remain segregated rather than become integrated into their host nations. The survey results mirror the findings of dozens of other recent polls. Taken together, they provide ample empirical evidence that scepticism about Muslim immigration is not limited to a “right-wing” political fringe, as proponents of multiculturalism often assert. Mainstream voters across the entire political spectrum are now expressing concerns about the role of Islam in Europe.

The disconnect referred to in the article constitutes one of the most worrying developments in Western culture over the last decade: between a elite that controls much of the discussion in the public sphere (journalists, academics, talking heads, mainstream politicians) and who fear being called Islamophobes and racists more than they fear Islamist racists, and a population of people who, whenever they voice concern about the behavior of the Muslim neighbors, are told not to be Islamophobic racists. The problems are knotty and painful to disentangle. Here’s my outline of an approach. (For a longer version of the following essay, see my blog, The Augean Stables.)

Honour-shame and Islamism:

In an honour culture, it is legitimate, expected, even required to shed blood for the sake of honour, to save face, to redeem the dishonoured face. Public criticism is an assault on the very “face” of the person criticised. Thus, people in such cultures are careful to be “polite”; and a genuinely free press is impossible, no matter what the laws proclaim.

Modernity, however, is based on a free public discussion, on civility rather than politeness, but the benefits of this public self-criticism – sharp learning curves, advances in science and technology, economic development, democracy – make that pain worthwhile.

But such a system represents a crucible of humiliation for alpha males, especially those who believe that the social order depends on the honour of ruling elite, like the anti-Dreyfusards around 1900, ready to sacrifice a single man for the honour of Army and Church.

This is particularly true for Islamic religious culture. In Dar al Islam, a Muslim’s contradiction/criticism of Islam was punishable by death, a fortiori did this hold true for infidels. Modernity has been a Nakba (psychological catastrophe) for Islam, and Islam in all its variegated currents has yet to successfully negotiate these demands of modernity.

On the contrary, the loudest voices in contemporary Islam reject vehemently the kind of self-criticism modernity requires. Criticism constitutes an unbearable assault on the manhood of Muslims.

Indeed, global Jihad and the apocalyptic prophets who nourish it with genocidal rhetoric, represent a particularly virulent form of abreactive modernity, in which the powers of modern society (especially technology) are turned to the task of destroying a modern culture of public, free debate about what is fair.

Secularism demands more maturity, it requires that religions be civil, that they not use force (the state) to impose their beliefs on others. Religious communities have to give up their need to be visibly superior as a sign of being right/true. This involves high levels of both self-confidence and tolerance for public contradiction.

For Islam this is a particularly difficult challenge. For Islam’s formative period, it dominated. Dhimma laws spelled out the principles: infidels were “protected” from violence and death at the hands of Muslims as long as they accepted a visibly humiliating, inferiority. And among the key demands made on dhimmis, was that they not challenge, criticise, or in any way “insult” Islam or Muslims.

Contemporary manifestations of Islamic revival tend to handle the infidel “other” poorly. The peril to contemporary Christians and Jews in Muslim majority nations is mirrored in the behavior of Muslims in the expanding European enclaves, those zones urbaines sensibles, or Sharia zones, where the state’s writ no longer runs.

Thus, Islam’s – Muslims – relationship with the “other” (kufr, infidel, lit. one who covers [the truth]), is the great problem to resolve in this coming generation, and at the heart of that problem lies the ability of Muslims to tolerate criticism from outsiders.

We in the modern (and post-modern) West, who first forged these remarkable rules of self-restraint and created so rich, so variegated, so tolerant a culture, have a right to demand that Islam adopt these rules, certainly those who live in and benefit from the civil polities we have created. Indeed, if we treasure these values of tolerance, and freedom, and generosity towards the “other,” we owe it to ourselves and to the Muslims in our midst, to make this demand. Anything else, including the fantasy that this is not a problem, is cultural suicide.

And yet, so far, we are doing very badly, mostly because we avoid dealing with the problem. The “thin skin” of Muslims is proverbial, and much public, diplomatic, and even academic discourse tacitly acknowledges and placates that cultural reality. When Western positive-sum principles (we do everything we can to “get to yes,” win-win) meets Arab zero-sum principles (they can only win, if we lose), we most often lose (Oslo “Peace” Process).

In the last decade this has gotten much worse. The behaviour of the self-identified “progressive” “left” – traditionally the bastion of stinging public criticism of abuse of power, misogyny and belligerence – has been overwhelmingly placatory towards touchy Muslims. Repeatedly, as in the case of Pope Benedict, they step in to prevent anyone (fellow infidels), whom they smear as Islamophobes, from saying something that might bruise Muslims feelings. Indeed, they seem more worried about “us” provoking Muslim violence than about exploring the sources of Muslim violence. And often they attack those defending democratic principles with a shrill and contemptuous tone that they would never dream of using with Muslims.

Which brings us back to the “disconnect.” Our journalist and academic talking heads are subject to a different kind of Islamophobia: an inordinate fear of criticising Islam. And as a result they betray their own real constituencies, those of us committed to the rules civil polities. We cannot defend modern, tolerant, liberal political culture with such fearful people dominating the public sphere.

The assault on our Constitution continues.

As we have reported extensively, Captain Paul Fields was disciplined for refusing to obey an order that violated his constitutional rights. We are certain a Muslim police officer would not have been ordered by the Tulsa police chief to attend Christian church services and Sunday school classes.

Now read the latest attack on our freedoms below, posted recently in Jihad Watch (highlights added). The OIC (Organization of the Islamic Conference) continues its assault on free speech at the UN through the advance of resolution 16/18. This resolution, cloaked in terms such as “defamation of religion,” is a thinly veiled attempt to criminalize speech that criticizes Islam.

But now, in an ominous development, according to a story published by the International Islamic News Agency, Secretary of State Hillary Clinton has joined the effort to implement this effort to criminalize free speech.

JEDDAH, Ramadan 1/Aug 1 (IINA)-During the next few months, Washington plans to host a coordination meeting to discuss with the Organization of Islamic Cooperation (OIC) how to implement resolution no. 16/18 on combating defamation of religions, and how to prevent stereotypes depicting religions and their followers; as well as disseminating religious tolerance, which has been endorsed by the UN Human Rights Council last March, in agreement with Western countries. The resolution was adopted after lengthy discussions held between the OIC and countries in which the phenomenon of Islamophobia is in the rise. The U.S. Secretary of State Hillary Clinton had announced the intention of the U.S. State Department to organize a coordination meeting during her participation in the meeting which she co-chaired with the OIC Secretary General, Professor Ekmeleddin Ihsanoglu in Istanbul on 15 July 2011. The meeting issued a joint statement emphasizing the dire need for the implementation of resolution 16/18. According to informed sources in the Organization of Islamic Cooperation, the two sides, in addition to other European parties, will hold a number of specialized meetings of experts in law and religion in order to finalize the legal aspect on how to better implement the UN resolution. The sources said that the upcoming meetings aim at developing a legal basis for the UN Human Rights Council’s resolution which help in enacting domestic laws for the countries involved in the issue, as well as formulating international laws preventing inciting hatred resulting from the continued defamation of religions. On the other hand, the OIC Secretary General, Ekmeleddin Ihsanoglu, stressed that the crime committed recently in Norway was a result of the rise of the extreme right in Europe and its easy mobility in political circles. He said that the OIC had warned several times against of what might be called institutionalization of the phenomenon of Islamophobia through the involvement of the European extreme right in government institutions and political action....

Charter school files
for bankruptcy

In early 2008, in one of the first grassroots activism efforts launched by ACT! for America, we helped bring nationwide exposure to a taxpayer-funded charter school that was clearly engaging in unlawful Islamic proselytizing in the school. ACT! for America members contacted the Minnesota Department of Education, Minnesota elected officials, even the ACLU, demanding action. Guy Rodgers, ACT! for America Executive Director, talked to a top official at the Minnesota Department of Education, who assured him they would investigate—and they did. Their investigation resulted in two citations against the school. In 2009 the ACLU did get involved, filing suit against the school alleging improper promotion of religion in a taxpayer-funded facility. So much for those claiming this was a right-wing vendetta against the school. The report below provides the latest on this issue—TiZA has filed for bankruptcy. The lesson here? Grassroots activism works.

TiZA school’s future falls to
bankruptcy court

Weeks after it ceased to exist in the eyes of the state, a metro-area charter school is making a case for its survival in bankruptcy court.

The Inver Grove Heights-based Tarek ibn Ziyad Academy filed for bankruptcy June 30, a day before it found itself lacking the state-approved overseer it needs to continue operation. The school since has asked the bankruptcy judge for permission to continue paying employees' salaries and benefits, stressing the value of saving its successful academic program.

Meanwhile, the American Civil Liberties Union asked the court to allow its 2-year-old federal lawsuit against the academy to move toward a resolution. The ACLU accused TiZA of promoting religion. The school has denied those charges, arguing it merely accommodated its primarily Muslim students.

These developments leave TiZA attorneys with a delicate balance to strike: They are championing the school's survival as they argue that its likely demise makes the ACLU lawsuit moot.

"How can TiZA adjust its religious accommodation policies if it doesn't exist anymore?" asked Shamus O'Meara, the school's lead counsel. "It's pretty nonsensical to try to push those claims forward."

At the start of this month, TiZA's overseer - the Washington, D.C.-based nonprofit Islamic Relief USA - became ineligible to continue its role because of a new charter school law that bans out-of-state overseers. Islamic Relief and the state were co-defendants in the ACLU lawsuit before settling out of court.

The state Education Department turned down an application by Twin Cities nonprofit Novation to take over as TiZA's overseer.

TiZA filed for Chapter 11 bankruptcy, which allows an organization to restructure and continue to exist. In court filings, the academy touts the high test scores and other achievements of its overwhelmingly low-income minority students.

"The continued operation of TiZA saves a successful program for the development of students," records say.

And to continue to operate, the school said, it needs to hang onto its staff of about 60. The school, which lists a monthly payroll of about $143,000, is asking the judge to allow it to continue paying its teachers and other employees over the summer.

An attorney for U.S. Trustee Habbo Fokkena argued against granting that request. The ability of the school to reopen in the fall is "clearly in dispute," wrote the attorney, Michael Fadlovich.

He especially objects to a severance clause in employment offers made in the weeks and months before the school filed for bankruptcy: If the school is forced to close, the offers said, employees would receive four months' salary - a liability of about $438,500 by his estimate.

Mark Kalla, TiZA's bankruptcy attorney, did not return a call seeking comment.

TiZA's Executive Director Asad Zaman said the school hasn't worked out a survival plan. Its leaders and legal team still are weighing a court appeal of the Education Department's rejection of Novation's application.

Zaman said he does not plan to re-invent TiZA as a private school, which would require lining up significant private resources.

O'Meara, the school's counsel, is more pessimistic. He said many TiZA employees scattered over the summer, and many students have requested their academic records so they can transfer to other schools.

"The reality is there isn't anyone to fill that school any more," O'Meara said. Meanwhile, the ACLU, the state and Islamic Relief have asked the bankruptcy court to lift a freeze on all legal actions that went into effect automatically when TiZA filed for bankruptcy.

For one thing, the state and Islamic Relief want to pursue repayment of more than $1.7 million in legal expenses that the federal court ruled TiZA should cover. The ACLU is seeking closure in the long-running case, which still is scheduled for trial in November.

Peter Lancaster, lead counsel for the ACLU, said the trial is unlikely with TiZA closed. Lancaster said the ACLU realizes it might not be able to get TiZA to repay millions in state aid or cover the group's own legal fees even as he questioned why TiZA had not yet filed information on its assets.

But Lancaster said the ACLU still hopes the court will approve the ACLU's settlement with the state and thus unseal records marked confidential during the lawsuit's investigative phase.

"The single most important thing we still hope to accomplish is the release of that information to the public," Lancaster said.

Lancaster and his team have argued the documents release would be "highly useful" to the bankruptcy court as well, throwing light on TiZA's financial dealings.

TiZA and its attorneys have called the issue of the settlement documents a misleading publicity stunt by the ACLU.

Judge Robert Kressel, who presided over the bankruptcy case of former auto mogul Denny Hecker, will rule on the various motions in coming weeks.

The vociferous assault on free speech in the wake of the Norway terrorist atrocity has reached a point where a blogger the Norway terrorist cited was questioned for several hours by Norwegian police officers.

Norway, Free Speech, and the Counterjihad

Ever since the heinous murders in Norway, we have been subjected to an unrelenting campaign of vilification. It appears that the Norway mass murderer Anders Breivik cited us, along with John Locke, Thomas Jefferson, Barack Obama and a host of others, in his lengthy cut-and-paste manifesto; despite that manifesto's ideological incoherence, his citations of our work have led to an international campaign to blame us for the massacre. The New York Times, NBC, the BBC, CNN, the Washington Post, many European publications, and a host of others have claimed that we are responsible for creating a climate of "hate" in which a Breivik was inevitable. This is not only false, but such charges against us challenge fundamental principles of the freedom of speech.

We submitted this present article defending ourselves to the New York Times, the Washington Post, the Washington Times, the New York Post, National Review, the American Spectator, the London Spectator, the Guardian, and the Wall Street Journal. Most ignored the submission altogether; National Review and the New York Post were the only ones who bothered to inform us that they were turning down the piece. The mainstream media was ready and eager to demonize us, but not so willing to give us a fair hearing and a chance to rebut their false charges.

In the first place, the claim that we are engaged in focusing hatred upon or engaged in demonizing any group is false. In fact, it is more true of our opponents' attacks on our own work than it is of anything we have said or done. We stand and have always stood against the evil of using violence for political and religious goals, and against all political and religious fanaticism. We stand and have always stood against the use of violence to advance any political agenda. We have stood consistently and still stand for the freedom of speech, the freedom of conscience, and the equality of rights of all people before the law. Anyone who sincerely upholds and wishes to defend those principles, whatever his creed or background, we count as an ally.

Those who claim that we have incited hatred that leads to violence are using an argument that can be used against themselves. Critics of American and NATO foreign policy should note that there have been numerous terror attacks committed by people who oppose that foreign policy. Are such critics responsible for creating a climate of hatred that led such people to commit terror attacks? In the 1960s, the Ku Klux Klan blamed Martin Luther King, Jr. for the Watts riots. King was steadfastly nonviolent, but he agreed with the political perspectives of the rioters. Was he then responsible for creating a climate of hatred that led to the riots? Was his righteous cause delegimitized by the fact that some departed from his express wishes and resorted to violence?

What's more, the media outlets that have blamed us for the Norway murders are practicing a double standard. Just days ago, a Muslim soldier in the U.S. Army, Pfc. Naser Abdo, was arrested with bomb materials. He admitted to plotting another jihad terror mass murder spree at Fort Hood in Texas, in support of Army psychiatrist Nidal Malik Hasan, who murdered thirteen Americans in a jihad attack there in November 2009. There have been dozens of such plots thwarted in recent years, and tens of thousands of jihad attacks worldwide. Yet there has been nothing remotely comparable to the intense and obsessive mainstream media coverage that we witnessed immediately after the Norway massacre. There has been no media attempt to determine the motivation behind this explosive plot at Fort Hood or the other jihad attacks. Why aren't Brian Williams, Anderson Cooper, the New York Times, the Los Angeles Times, the BBC, and all the rest just as consumed as they were with the Norwegian killer's supposed motivations? Why aren't they investigating the ideology that incited this Muslim soldier to prepare a jihad attack, especially in light of his stated intent last year to fight "Islamophobia" and promote Islam as a "peaceful religion"?

Ultimately, the arguments that have been used to blame us for the Norway attacks can be used against anyone of any ideological perspective, and strike at the very heart of the freedom of speech. By their logic, no one should be critical of anything, for fear that some evil person will misunderstand that criticism and commit violence because of it. The mainstream media itself can be seen as inciting violence in its sharp criticism of our perspective: the murders of Theo van Gogh and Pim Fortuyn, as well as the multiple threats against Geert Wilders, Ayaan Hirsi Ali, Wafa Sultan, and both of us, amply demonstrate that criticism of anti-jihadists can and does often lead to violence. Should that criticism thus be muted?

The constitutional protection of the freedom of speech is designed to protect controversial speech, including political dissent. Innocuous speech needs no protection. The truths that we enunciate are inconvenient for many to acknowledge, and the principles of freedom for which we stand are increasingly assailed. For that reason alone, the international media should be more circumspect in its demonization of us and our perspective; otherwise they may find, after having silenced all dissenting voices, that there is no one left who is able to stand up for the freedoms they now enjoy.

Fatwa rationalizes pedophilia


Dear Elaine,

The commentary below highlights a recent fatwa issued by a top Saudi cleric regarding child brides and sex with female children.

Note this statement from the fatwa, regarding how old girls should be before marriage. Dr. Salih bin Fawzan asserts that “…the only criterion is that they are capable of being placed beneath and bearing the weight of men.”

For those who claim this can’t be happening in America, we have seen reports of Muslim men immigrating to Europe, the UK, and to the United States, and identifying their child brides as relatives, such as daughters, in order to avoid scrutiny from Western laws that prohibit pedophilia.

We have no doubt this is happening here. Just one more example of how sharia law is penetrating and threatening America.

Rationalizing Pedophilia in Islam

Earlier this month we saw—or rather, were once again reminded—that Islam permits pedophilia in the guise of "marriage": Top Saudi cleric, Dr. Salih bin Fawzan, issued a fatwa asserting that there is no minimum age for girls to marry, "even if they are in the cradle," and that the only criterion is that "they are capable of being placed beneath and bearing the weight of the men."

Admirable patience to childish antics

While this practice speaks for itself, it is interesting to witness the great lengths some Muslims go to justify or rationalize it—or even to turn it into a source of pride.

Consider, for example, this Muslim cleric discussing Muhammad's marriage to the child Aisha when she was nine. Far from blushing for shame, the cleric actually uses this anecdote to boast of the prophet's "patience" and "magnanimity." Translation of relevant excerpt follows:

The story of the prophet's marriage to Aisha reveals to us aspects like the prophet's conduct with Aisha, and more importantly the aspect regarding the relationship between the husband and wife, to show how one should treat his wife, just as the prophet did with Aisha.

We know that Asia's mother went to take her down from the swing that she was playing on to fix her hair and prepare her for the prophet so he could enter her [have sex with her]—and she did that all on the same day.

Aisha's own account in Sahih Bukhari is telling enough: she talks about how her mother hurriedly prepared her and then "handed" her over to Muhammad, and how "nothing surprised me but the coming of Allah's Apostle to me in the forenoon."

The cleric continues:

So you see, she was playing with her fellow playmates even though her day of consummation was that very same day—and all that they did was to fix her up for the prophet so he could have sex with her.

Now what do we see when the prophet married Aisha? Did he go to her and say "Okay that's it, you're married, you're now a grown up, you're supposed to be mature, you need to do this and that; you need to forget about your toys and your little friends; you are now a wife of a man, you have to see to my needs" and that's it?

No. The prophet allowed her to continue playing with her toy dolls—indeed, the prophet even sometimes gave her such things to play with. [This hadith has more details, including how Aisha's little girl friends would "hide themselves" whenever the prophet came to her until he called them out.]

It should be noted that the cleric recounted the above with much awe and amazement—as if to say, "Look how indulgent and open-minded our prophet was!"

In fact, such was the cleric's whole point: to show that Islam, according to the example of Muhammad, expects older Muslim husbands to be patient with their younger wives: "The older husband should not expect the younger wife to be at his level of maturity; rather, he should go down to her level, for he is capable, whereas she is not."

As "gentlemanly" as this ostensibly sounds, it is yet another example of how Muslim scholars deal with Muhammad's lifestyle: because they cannot condemn or ignore his practices, they inevitably go to great lengths to rationalize or justify them—to find the good in every situation their prophet was involved in, while being oblivious to all the bad.

Thus here we have a cleric straining to finding a positive aspect to Muhammad's pedophilia—that he was patient and indulgent of his child-bride—while ignoring the heart of it: that the man Islam is built around desired to have sex with a child in the first place.

“Conscientious Objector” targeted soldiers


Dear Elaine,

On July 14^th, we emailed you a column by retired Admiral James Lyons, in which Lyons criticized the Army’s decision to grant conscientious objector status to a Muslim soldier who claimed he could not kill other Muslims.

We maintained in that email that conscientious objector status has historically been granted only to those with a sincerely held belief that killing ANYONE, not those of a particular group, was wrong.

We have since learned that this very soldier had made “radical” statements (reminiscent of the Ft. Hood jihadist), and yesterday he was arrested on suspicion of planning to kill fellow soldiers in a terrorism attack (see story below).

Obviously, rather than being a conscientious objector he is another jihadist in the military.

Thankfully, none of our soldiers were killed this time. Will the Army leadership now learn the lessons it didn’t learn after the Ft. Hood massacre?

A U.S. serviceman is in custody after he allegedly admitted he was planning an attack on his fellow servicemen at the U.S. Army base at Fort Hood, Texas, the same base where 13 people were killed in a 2009 terror attack.

U.S. officials told ABC News an AWOL soldier, identified by the FBI as a Private First Class Naser Jason Abdo, was arrested Wednesday after making a purchase at Guns Galore in Killeen, Texas, the same ammunition store where Maj. Nidal Hasan purchased the weapons he allegedly used to gun down 13 people and wound 32 others on Nov. 5, 2009. According to one senior official, Abdo has also mentioned the name of high profile al Qaeda cleric Anwar al-Awlaki -- the same man investigators said inspired the previous Fort Hood attack along with other potentially deadly terror plots in the U.S. -- though no direct link between Abdo and Awlaki has been found.

Abdo, 21, allegedly told law enforcement he wanted to "get even" and was targeting Ft. Hood because of the previous attack there, according to law enforcement documents obtained by ABC News. The documents say he did not plan to attack the base itself, but instead planned to plant two bombs at a nearby restaurant popular with Ft. Hood personnel.

He hoped to detonate both at the target location before using a pistol to shoot survivors, according to the documents. Abdo had gone AWOL over the July 4 weekend from Fort Campbell's 101st Airborne Division in Kentucky over 800 miles away.



When he was arrested, Abdo was in possession of large quantities of ammunition, weapons and what appeared to be the makings of a bomb, according to early accounts from law enforcement. He had also apparently purchased an Army uniform with Fort Hood patches from a local surplus store.

Sources: Soldier Had Made 'Radical Statements'

Abdo, reportedly of Palestinian descent, was raised by his Muslim father and non-denominational Christian mother in Texas. In 2010 he told ABC News he was Muslim and should not have to participate in what he called an "unjust war" in the Middle East.

"Any Muslim who knows his religion or maybe takes into account what his religion says can find out very clearly why he should not participate in the U.S. military," Abdo said then.

Abdo said in 2010 he originally joined the military because he believed he would be fighting a "just" war that would help protect the freedoms of Muslims in Iraq and Afghanistan. Months later, however, Abdo said he realized he "wasn't supposed to be here."

Abdo filed for conscientious objector status, which was approved by the Secretary of the Army, but his discharge was put on hold after Abdo was charged with having child pornography on his computer, an Army spokesperson told ABC News. Law enforcement sources said investigators began looking at Abdo's computer files due to "radical statements" he made after filing for discharge and only discovered the pornography then.

On a Facebook page apparently maintained by Abdo, he writes in the most recent post on June 22 that it was two days after the Secretary approved his discharge that he was charged with having 34 images of child pornography on the computer.

"As god says, 'The end is ultimately with the believers' Quran," the post says.

“Al Shabaab: Recruitment and Radicalization within the Muslim
American Community and the Threat to the Homeland”

Yesterday, House Homeland Security Committee Chairman Peter T. King (R-NY) continued to follow through on the promise he made at the start of the 112^th Congress—to address the threat of radical Islam in America. Yesterday, he held his third in a series of hearings on Muslim-American radicalization, this one entitled: “Al Shabaab: Recruitment and Radicalization within the Muslim American Community and the Threat to the Homeland.” I attended the hearing so that I could offer you a first-hand report.

As I noted after Chairman King’s second hearing (covering radicalization within the U.S. prison system), we didn’t see the full-blown circus that attended his first discussion on radical Islam. However, I have to say that the behavior of some congressional members of the Committee was appalling. This is a serious subject that demands serious examination, and it is deeply disappointing to watch some of the members of the Committee act with the disrespect they showed yesterday.

The discussion yesterday was based on the result of what Chairman King called a “lengthy investigation the Committee has conducted into the threat the U.S. homeland faces from al-Shabaab, the Somalia affiliate of Osama bin Laden’s al-Qaeda and Anwar al-Aulaqi’s al-Qaeda in the Arabian Peninsula (AQAP).” The report found, among other concerning things, that over 40 Muslim-Americans and 20 Canadians have been recruited and radicalized by al-Shabaab. The purpose of yesterday’s hearing by Chairman King was clear: We see a problem developing that has severe implications for our national security; we take this seriously; we need to address it NOW.

The witnesses for this particular hearing had varied but formidable backgrounds:

Mr. Ahmed Hussen – National President, Canadian Somali Congress. Mr. Hussen stated that his group is a “national advocacy organization that advocates on issues of importance to the 200,000 strong Canadian Somali community.” He told the Committee that as a Canadian Muslim he is “proud of his heritage” and thanked Chairman King for holding a hearing on this critical issue as, he said, it helps the Somali community, both in the U.S. and Canada, fight against those who wish to do either nation harm. Further, he said that it is important that the leaders in the Somali-Canadian and Somali-American communities “emphasize integration and the adherence to and respect for American and Canadian values and not those that promote separation, extremism and victimology.” See Mr. Hussen’s full testimony HERE.

Mr. Thomas Joscelyn – Senior Fellow, Foundation for Defense of Democracies. Mr. Joscelyn noted that a majority of Somali-Americans do not support al-Shabaab, nor its agenda. That said, he believes that there is a serious danger to our nation from al-Shabaab and though there is “great confusion here in the U.S. as to whether or not Shabaab is really a part of al Qaeda’s international terrorist network…my view is that the link is much stronger than some counterterrorism analysts realize.” See Mr. Joscelyn’s full testimony HERE.

Mr. William Anders Folk – Former Assistant United States Attorney, District of Minnesota. Mr. Folk agreed with the other witnesses that al-Shabaab is a serious threat to the United States and that to fight them and their supporters, the U.S. “must engage in a multi-faceted approach that utilizes all of the United States’ abilities, including military, intelligence, law enforcement and diplomatic options. Further, this effort must be carried out in Somalia, the Horn of Africa, and the United States.” See Mr. Folk’s full testimony HERE.

Mr. Tom Smith – Chief of Police, Saint Paul, Minnesota. Chief Smith updated the Committee about efforts taking place in St. Paul to combat al-Shabaab’s impact on the Somali-American community there. During his testimony, he noted another problem with which they are dealing: Somali girls not only in Saint Paul and Minneapolis, but also in Tennessee and other states are being sexually trafficked. The discussion during yesterday’s hearing was a critical one. Again, what was tremendously disappointing to me was the recurring rude and disrespectful behavior (both to the Chairman and the witnesses) by certain Members of the Committee. This has happened at each of Mr. King’s hearings on Islamic radicalization. Though national security should be a non-partisan issue, once again, the perpetrators were all Democrats. To me, it demonstrated a serious problem: how unknowledgeable, disconnected and disinterested some Members of Congress are about a very real and dangerous threat to our nation.

Some examples:

Rep. Shiela Jackson-Lee (D-TX) – as usual, was bent on making a show out of her comments instead of adding substance to the dialogue and learning from the experience of the witnesses. As during prior hearings, she made formal requests that the Chairman instead hold hearings on right-wing extremist organizations, as well as one on Rupert Murdoch. When her comment period expired and the Chairman informed her that it had, she continued speaking over him. It took several attempts of “the gentle lady’s time has expired” to get her to settle down. The cameras were rolling and she knew it.

Rep. Laura Richardson (D-CA) – commented that the scope of the Chairman’s series of hearings is discriminatory.

Rep. Yvette Clarke (D-NY) – argued that radicalization is “cross-cultural, cross-religious, and cross-ethnic” and that if we focus on only one group we open ourselves up to “the disdain of others.”

Rep. Cedric Richmond (D-LA) – noted to Chairman King that this was his third hearing on the issue of Islamic radicalization within the U.S. and said “point made. Let’s move on.”

But the most outrageous comments during the hearing, came from Rep. Al Green (D-TX), who does not serve on the Committee but asked (and was granted) time to speak. [NOTE: The Chairman did not grant the same, this time, for Rep. Keith Ellison, another legislative showman, who dramatically broke down in tears during King’s first hearing.] Early in his comments, Mr. Green asked all of the witnesses if they had ever heard of Jihad Jane. When they replied that they had, he continued his line of questioning, asking them what her hair color was, her eye color, her height, and finally, her complexion. He asked the witnesses if acknowledging that she was “as she is called in America, a white woman” took them “out of their comfort zone.” Clearly, he was insinuating that the Chairman and the committee were racist by focusing on Somali-Americans. When Chairman King responded that the questions had absolutely no basis and made no sense to him, Rep. Green shot back, “I didn’t expect it to make sense to you.”

I do think it is worthwhile to watch the full hearing, so you can see how the issue was taken seriously by the witnesses and some Members of Congress, such as Rep. Chip Cravaack (R-MN), Rep. Jeff Duncan (R-SC), Rep. Mike McCaul (R-TX) and Rep. Dan Lundgren (R-CA), as well as those I mention above, who were only interested in distractions. This hearing took place at the courtesy of your tax dollars and you have a right to know what your elected officials are doing on Capitol Hill. As the Chairman noted in his Opening Statement, which we sent out to our full membership shortly after it was released (click HERE to view it in its entirety) “I will not back down from holding these hearings. I will continue to hold these hearings so long as I am the Chairman of this Committee. I…owe it to all the friends, neighbors, and constituents I lost on September 11th. I will not back down.”

We need to be appreciative of Mr. King’s past and future efforts in the U.S. Congress on identifying and addressing radical Islam within the U.S. Contrary to what some Members of the Committee claim, he never has and never will focus on the peaceful Muslims living in America. This is not about them and, frankly, these hearings will benefit them. These discussions are about identifying and immobilizing those individuals who follow an ideology that is contrary and dangerous to the freedoms afforded by our U.S. Constitution—those who strive to do harm to our nation and our citizens.

Finally, we need to let Chairman King and all other Members of Congress who continue to speak out about this issue know that a grateful nation—certainly including the 170,000 members of ACT! for America—is behind them 100 percent.

As for those Members of Congress who do not take this seriously, who seem intent only on making a mockery of these hearings, they need to hear from their constituents too. They need to be told that they took an oath to defend the Constitution and they need to start taking these discussions about Islamic radicalization seriously.

The Norway Terrorist

Dear Elaine,

We in ACT! for America join those around the world who are shocked and deeply saddened by the mass murder spree in Norway. We grieve for those killed, for their families, and for their friends.

This touches me very personally. I have seen friends murdered by terrorists and I have felt the unspeakable pain of that loss.

We also join those around the world who condemn, in the strongest words possible, the unconscionable actions of Anders Behring Breivik.

Not surprisingly, Brevik’s 1,500 page manifesto is being combed for clues as to why he would perpetrate such a heinous act of terrorism.

For instance, a New York Times article states Breivik was “deeply influenced by a small group of American bloggers and writers who have warned for years about the threat from Islam…” He also frequently quoted the Unabomber.

Predictably, and sadly, there are those who have started the drumbeat that rhetoric critical of radical Islam is the cause of this tragedy. We have seen ludicrous online posts conjuring up comparisons to Breivik and conservative American political leaders that I won’t dignify by reprinting here.

This is reminiscent of what happened after the Tucson shooting spree, when many in the press jumped to conclusions that Jared Loughner was a “right winger” or a “tea party activist.”

A column by Mark Tapson in FrontPageMagazine has some very important points in this regard.

Breivik is a terrorist. His targeting of helpless schoolchildren makes him no better than the slaughterers at Beslan…. There is no connection between the legitimate, courageous, lawful work of notable anti-jihadists and such evil. No true Christian, conservative, or responsible critic of jihad would condone Breivik’s despicable, cowardly acts or deem them to be in accordance with our beliefs and values. Much less would we celebrate those acts, unlike our Islamist counterparts.

In my home country of Lebanon I saw first-hand what happens when terrorism and violence is used to undermine democracy. When 9/11 happened, I made a vow that I would not allow what happened to my country of birth happen to my adopted country.

This is why the mission of the organization I founded, ACT! for America, has ALWAYS been and will ALWAYS be a call to constructive, peaceful and democratic citizen action through education, community action, and legislation.

Sharia Law and Polygamy
in America


The column below (highlights added) by Andrew Bostom zeroes in on one aspect of the threat of sharia to the West: Islamic polygamy. An NPR article in 2008 cited sources estimating that as many as 100,000 Muslims live in polygamous families in the U.S.

Note that the Assembly of Muslim Jurists of America has issued fatwas sanctioning polygamy, in keeping with sharia law. One ruling declares American law prohibiting polygamy “against Islamic law.”

Despite an overall apologetic tone borne of transparent obeisance to cultural relativism, two legal academics, Dr Ann Black and Dr Kerrie Sadiq from The University of Queensland TC Beirne School of Law are “suggesting [2]” in their research publication, “Good & Bad Sharia: Australia’s mixed response to Islamic Law” (due to be published in the University of New South Wales Law Journal on Monday July 25, 2011) that,

Australia is right to act with caution in dealing with Sharia law.

Why are even these obviously [2] devout votaries of the academic social religion of cultural relativism concerned about the practice of Sharia in Australia at all, or what they term, with revealing euphemism, “legal pluralism?”

One reason was extracted from the forthcoming paper of Drs. Black and Sadiq, and cited by The Australian’s legal affairs editor, Chris Merrit [3]:

Valid Muslim polygynist marriages, lawfully entered into overseas, are recognised, with second and third wives and their children able to claim welfare and other benefits.

Merrit’s background article on Black and Sadiq’s findings also noted [3] how this practice of Muslim polygamy in Australia involved “marriages where one party is under the lawful marriage age.” And Merrit provided this additional context [3]:

The findings come soon after Ikebal Patel, president of the Australian Federation of Islamic Councils, triggered a backlash inside the Islamic community when he called for Australia to compromise with Islam and embrace legal pluralism …The latest research has found that while polygamy is unlawful, mainstream law accommodates men who arrive in Australia with multiple wives and gives some legal standing to multiple partnerships that originate in Australia.

More alarming “context” not addressed by the report of Drs. Black and Sadiq, and in fact dismissed by Dr. Black [2] in these words, “The ‘foreignness’ of Sharia law is increased by media reports which highlight ‘differences’ and feed into fears about the Muslim presence in Australia,” was provided by The Australian Daily Telegraph [4]:

On Sunday, a recent convert to Islam in Sydney was allegedly lashed 40 times with electrical cable by men from his mosque, in a terrifying home invasion, as punishment for drinking alcohol – forbidden under Shariah law. Two people have been arrested in connection with the attack.

The staid report by two Australian cultural relativist academics should (but won’t) make our mainstream media talking heads curious about how mainstream Islamic opinion views polygamy in the United States. For example, what have the esteemed mainstream Islamic clerics of the Assembly of Muslim Jurists of America (AMJA) opined regarding polygamy? The AMJA [5] mission statement maintains:

[The AMJA was] founded to provide guidance for Muslims living in North America. … AMJA is a religious organization that does not exploit religion to achieve any political ends, but instead provides practical solutions within the guidelines of Islam and the nation’s laws to the various challenges experienced by Muslim communities.

A report in The Muslim Observer [6] published October 21, 2010, highlighting AMJA’s “seventh annual American conference of imams,” confirms that the organization is accepted [6] as such by the mainstream American Muslim community. AMJA and its recent “training” conference for American imams were described [6] in these banal terms:

The organization AMJA (Assembly of Muslim Jurists of America) has a list of scholars associated with it which stretches from Al-Azhar University to Virginia’s Open University, and back across the ocean to the professors at Saudi universities. Its website, amjaonline.com, provides fatawa on many issues and promises 24-hour access to scholars who can give legal opinions on the issues people face. AMJA focuses on providing fatwas to Americans, and believes it is able to provide culturally appropriate fatwas although many of their scholars are not American–because they have some American scholars and because of the technological ties that bind AMJA’s American scholars with those abroad. AMJA just had, in Houston, its seventh annual American conference of imams, and two local Michigan imams attended, namely Imam Musa of Bloomfield’s Muslim Unity Center, and Imam Ali of MCWS. Mr. Sadiqul Hassan of AMJA explained that “the event was the 7th annual imam workshop.” Mr. Hassan said that AMJA is “a fiqh council basically,” with “scholars who live abroad and inside the U.S.; we have experts in different fields to educate about life in the U.S. — fatwa are based on life in the U.S.”

Not only does AMJA extol polygamy in accordance with the Sharia, AMJA endorses its extra-legal (i.e, vis a vis US law) application here in America, as can be readily gleaned from these two “fatwas” or Islamic legal rulings:

Polygamy in Islam is permissible for different reasons, like:
1- The sexual energy of men is more than that of women in general. So, in some cases, one wife is not enough to fulfill the conjugal desire of her husband
2- Pregnancy and delivery negatively affect the shape and physical attraction that women have.
3- World wide, the percentage of females is always more than that of males, eventually, there must be a solution, either to permit adultery and prostitution, or to allow polygamy
4- One husband could take care of more than one wife at the same time; socially, financially, and even sexually as I mentioned above. However, the opposite is not right because of the physical and psychological capability that Allah the all mighty gave men.

Comment from Muslim questioner: We know that polygamy is against USA law. But I heard from my friend that as long as you don`t register your marriage to the registrar, it is okay to have more than one wife here in the states, i.e., all the wives are living here. The argument that he made was that the law that prohibits marrying more than one is against the shaariah so, it is okay for us to break it…There are some scholars in the USA are practicing polygamy without the knowledge of the authorities using that argument….

Dr. Hatem al-Haj’s response: Polygamy is halal in Islam and may be highly recommended when the number of females is bigger than that of males to afford all females a decent life that suffices their physiologic, emotional and other needs. The US law about polygamy is against the Islamic law, for no one can make prohibited that which Allah specifically made allowable.

News Report: Hezbollah working with drug cartels on the border


For years, ACT! for America president Brigitte Gabriel has been warning Americans about terrorist organizations such as Hezbollah partnering with Mexican drug cartels.

Rep. Sue Myrick, recipient of our top legislative award the past two years for her courageous efforts to protect our national security from radical Islam, has relentlessly pursued the Department of Homeland Security (DHS) on this matter.

DHS’s response has been “we see no evidence of Hezbollah partnering with drug cartels in Mexico.”

The Herald Sun (Australia) story below provides yet ANOTHER example of the forward march of sharia law around the world.

Those who dismiss concerns about sharia law, such as Bob Smietana’s recent article in The Tennessean newspaper, appear to have no problem with how sharia law applies to women and children.

For instance, nine months ago the Assembly of Muslim Jurists of America (not of Saudi Arabia), issued a fatwa declaring that, according to Islamic law, rape cannot exist in a marriage because a woman is required to consent to her husband.

It was this reasoning that prompted a New Jersey judge in 2009 to deny issuing a restraining order against a Muslim man who was sexually abusing his wife.

Sharia law provides that a woman’s testimony in court is equal to only half that of a man’s. A man can beat his wife if she is insubordinate. A man can divorce his wife by saying “I divorce you” three times; a woman has no such right. Women have virtually no rights over the custody of their children. And on and on.

So here is our question to the naysayers: Do you believe sharia law should be applied in America in the area of “family law”? If so, any claims you make to support equal rights for women—or even their protection—are hollow.

ISLAMIC leaders want Muslims in Australia to get interest-free loans for religious reasons.

The nation's Islamic leaders want recognition of sharia law as it applies to banking practices, according to an exclusive Herald Sun survey of imams.

There was also a call for recognition of sharia law as it applies to family law.

The survey showed some imams are sceptical that Osama bin Laden's death will be of benefit to ordinary Muslims, and they are unhappy with the way US forces disposed of his body.

The survey has also revealed:

STRONG condemnation of MPs who criticise Muslim women for wearing the burqa/nijab.

CONCERN that ordinary Muslims are still being linked to terrorism.

DISGUST that innocent people in Muslim countries are being killed in the "war on terror".

The survey was conducted in the wake of a $55,000 Federal Government training program for imams on Australian laws and values.

They have been told to preach core Australian values such as the fair go, freedom, and responsibility.

Imam Yusuf Parker, from the Alhidayah Centre in Perth, said Australia should consider recognising sharia law as it applied to finance and family law matters.

Imam Parker said Islam forbade the charging or paying of interest "so finding interest-free loans will again help Muslims to practise their Islam better".

"Other than the two major issues mentioned, I don't see other sharia law that Muslims would seek to have legally recognised," he said.

Fellow WA imam Sheik Burhaan Mehtar said sharia law often was raised to scare non-Muslims, but a dialogue would lead to better understanding.

"Islamic banking and the non-slavery of humans is a classic example. Interest is slavery," he said.

Islamic Council of Victoria board member Nazeem Hussain said legal and tax barriers currently prevented local banks from offering Islamic finance products.

"That's a massive market ... we'd encourage the Government to seek ways to tap into that market," he said.

Imam Parker said bin Laden's demise might serve as closure for those convinced he masterminded the 9/11 attacks.

"But the reality is that the negative impact on Islam and Muslims has not changed, and it will take many decades for that to change," he said.

Sheik Burhaan Mehtar said the symbolic victory of bin Laden's death would remain hollow while people in nations such as Afghanistan suffered a "terror of death delivered from the skies" by the US and its allies.

Gold Coast imam Imraan Husain reflected a general view that bin Laden's burial at sea was a violation of Islamic funeral rites.

Victorian imam Sheik Ramy Najmeddine said Muslims felt there was an unfair link between terrorism and Islam.

"But we believe this is being broken down by the good work that members of both the Muslim and non-Muslim community are doing."

Sheik Mohamadu Saleem, a spokesman for Board of Imams Victoria, accused some MPs of trying to get political mileage out of the burqa issue. "It is mere political expediency," he said.

Victorian imam Abdinur Weli said: "If only Muslims are the people who are told what to wear, then it is discrimination."
