Dimitrios Pagourtzis, 17, was charged Friday as an adult with capital murder and aggravated assault on a peace officer, but cannot face the death penalty, according to a 13-year-old Supreme Court decision.

According to a report by criminal justice website The Marshall Project cited by USA Today, Texas has tried 17-year-olds like Pagourtzis as adults in state courts. But the Supreme Court’s 2005 Roper v. Simmons decision found that capital punishment was a violation of the Eighth and 14th Amendment prohibitions against cruel and unusual punishment.

Moreover, SCOTUS ruled in 2012 that juveniles cannot face life in prison, either.

In other words, the teenager accused of killing eight students and two teachers as well as injuring 13 others could be eligible for parole around 2058, near his 57th birthday.

“The courts ruled based on the idea that those 17 and younger don’t have the cognitive development to appreciate right from wrong,” Michael Radelet, a University of Colorado at Boulder sociology professor who often testifies in death-penalty cases, told USA Today.

“Cases like this that are especially violent and an enigma make some people think they are more deserving of death,” he added, “but the ruling is about the development of the juvenile brain.”

The 2012 decision in Miller v. Alabama means that he likely cannot be held without hope of parole, either.
Radelet argued, however, that the accused shooter, if convicted, would still face justice even though these two most extreme forms of punishment may be off the table.
“It’s wrong to say this young man can’t be held responsible for these crimes,” Radelet said. “Forty years is a tough row to hoe, and even then a parole board might not agree he’s not totally damaged or able to make a satisfactory transition into the community in 2058.”

Capital punishment researcher Victor Streib said that 366 or more juveniles have been executed in the U.S. since 1642, although no information was provided about what percentage of those occurred before the Revolutionary War and under British, Dutch French or Spanish colonial rule.

Texas has executed 551 convicts since 1976, roughly a third of all the executions performed in the U.S. during that period.

A total of 243 prisoners await execution in Texas today, according to Death Penalty Information Center information cited by USA Today.

The last execution of a prisoner convicted for a crime committed while a minor was in Oklahoma in 2003, Streib said.

The accused shooter planned his attack on his computer and in a journal before entering Santa Fe High School in Texas, where he was a student, Friday morning with a shotgun and a .38 revolver.

Both weapons were reportedly legally owned by the suspect’s father.

President Donald Trump interrupted a news conference shortly after the shooting occurred to express his condolences for the victims and their families.

As information begins to trickle in about the Sante Fe school shooting, some disturbing facts are coming to light.

Most notably, the shooter was wearing a communist pin found on previous school shooters.

Disturbing Signals
After the tragic shooting, most people interviewed said there were no signs Dimitrios Pagourtzis was going to kill his classmates.

Now, however, we found out he was wearing a pin linked to ANTIFA.

Not only that, the same pin was worn by Columbine shooter Dylan Klebold…

 Dimitrios Pagourtzis was a columbiner. He had the same button that Dylan Klebold wore on his shoe during the columbine massacre. Lots of columbiners wear this button.

Perhaps it was too small of a signal for anyone to notice, but one would think a communist pin suddenly showing up at the house should have had someone asking questions.

A Town in Mourning
Sante Fe is one of those communities severely impacted by Hurricane Harvey.

There are still more than a few remnants of the storm, and now they have to deal with this as well.

By the time Pagourtzis was taken down, he had killed at least 10 people and left more than a dozen wounded.

U.S. Representative Randy Weber stated, “We will get through this.”

The shooting had many local law enforcement officials confused and devastated, simply not knowing how to keep the children in their communities safe.

Weapons and Signs
Because the shooter did not have an AR-15, this shooting is not getting all the headlines of the other school shootings.

Instead, the shooter had a shotgun and a handgun, proving that when evil wants to kill, evil will find a way.

What everyone seems to be missing, though, is why this is happening.

St. Mary’s County Sheriff Tim Cameron confirmed during a Tuesday press conference that one male student and one female student were injured when a shooter opened fire inside Great Mills High School, Maryland. The sheriff said “our school resource officer, who was stationed inside the school, was alerted to the event and the shots being fired.”

The sheriff continued:

“He pursued the shooter, engaged the shooter. He fired a round at the shooter. Simultaneously the shooter fired a round as well. In the hours to come, the days to come through detailed investigation, we will be able to determine if our school resource officer’s round struck the shooter. The school resource officer is uninjured and was not struck by any fire am projectile.”

The sheriff told reporters that the shooter died as a result of a gunshot wound and the school has since been evacuated.

Armed officers and teachers inside schools is among one of the more contentious issues in the national debate on gun violence.

President Trump has repeatedly called for arming up to 20 percent of school staff members in response to the school shooting in Parkland, Florida, which left 17 dead. In that shooting, the officer stationed at the school refused to engage the shooter.

Terrence Rhames, 18, a student at the school, told the Baltimore Sun he was standing with friends before class began when he heard a gunshot. He said he started to run and believed he saw a girl fall nearby.

“I just thank God I’m safe,” Rhames said. “I just want to know who did it and who got injured.

Jake Heibel, the principal of the school, told parents last month that the school had investigated threats of a possible shooting and found they were “not substantiated.” Heibel told parents that school officials interviewed two students in February who were overheard mentioning a school shooting and found that they posed no threat. His letter was posted on the local news site The Bay Net.

However, Heibel said the school still increased its security after social media posts about a possible school shooting “circulated quite extensively.”

Also last month, St. Mary’s County Sheriff’s office said it arrested two teenage boys for “Threats of Mass Violence” and a 39-year-old man on related charges after the teens made threats about a potential school shooting at Leonardtown High School, a high school about 10 miles from Great Mills. Police said they obtained a search warrant that led to them finding semi-automatic rifles, handguns and other weapons, along with ammunition.

The school is located about 60 miles from Washington, D.C. The St. Mary’s County Public Schools tweeted counselors and support staff would be on hand at Leonardtown High School.

A Maryland high school was on lockdown Tuesday morning after reports of a shooting, authorities said.

Police were at the scene at Great Mills High School in Great Mills, about 70 miles south of Washington.

Agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives were also responding.

The St. Mary’s County Sheriff’s Office said in a statement that the incident was “contained” but parents should not go to the school.

New York Daily News has more:

At least three people were wounded — including a gunman — when shots rang out Tuesday morning at a southeast Maryland high school.

There are no confirmed deaths in the shooting, which broke out at about 8 a.m. in Great Mills High School, officials said.

A school resource officer exchanged fire with and shot the gunman, who was wounded and is in critical condition, NBC News reported.

Two students were also wounded and are in critical condition, the network reported.

The school district tweeted that the situation “is contained,” and officials urged parents to head for a staging area about 10 miles away.

The Baltimore Sun reported that a student said the shooting happened around 8 a.m. Terrence Rhames, 18, told the Sun that he heard a gunshot and saw a girl fall as he ran for an exit. “I just thank god I’m safe,” Rhames said. “I just want to know who did it and who got injured.”

Maryland Gov. Larry Hogan and Rep. Steny Hoyer tweeted that they’re monitoring reports and urged people to follow the instructions of local law enforcement at the scene.

MedStar St. Mary’s Hospital was treating patients from the school shooting, according to a hospital spokesperson. The official would not say how many people are injured or discuss the extent of injuries.

The St. Mary’s County Sheriff’s Office confirmed that it was on the scene and urged parents to go to another school, Leonardtown High, to reunite with their children.
